Terms of Service

The rules, responsibilities, and limitations that apply when using Oho.

These Terms of Service govern your access to and use of Oho, including creator pages, digital products, newsletters, booking flows, collaborations, paid DMs, billing, and related services.

Agreement to These Terms

By accessing or using Oho, you agree to these Terms of Service and any policies or supplemental terms that are expressly incorporated into them. If you do not agree, do not use the service.

These terms apply to the public website, creator pages, dashboards, subscriptions, digital product sales, newsletters, bookings, collaboration workflows, paid DMs, support interactions, and any other services Oho makes available.

Eligibility, Accounts, and Security

You may only use Oho if you can form a binding contract and are authorized to do so on behalf of yourself or the entity you represent. You are responsible for the accuracy of the information you provide and for keeping your login credentials secure.

  • You are responsible for all activity that occurs under your account.
  • You must notify Oho promptly if you believe your account or an access link has been compromised.
  • We may suspend or restrict access if we detect fraud, abuse, security risk, or violation of these terms.

What Oho Provides

Oho provides software and related services that let creators publish pages, sell digital products, collect newsletter subscribers, accept bookings, manage collaboration requests, offer paid DMs, and review analytics and payout information.

Except for Oho's own platform subscriptions and any service we expressly identify as sold by Oho, creator offers on the platform are created and fulfilled by the relevant creator. Oho is not the creator, brand, buyer, or subscriber in those transactions merely because the workflow runs through our software.

User Content and Platform License

You retain ownership of the content, files, text, media, briefs, messages, and other materials you upload or submit to Oho. You grant Oho a non-exclusive license to host, reproduce, display, process, transmit, and use that content as necessary to operate, secure, and improve the service and to complete the workflows you request.

You are responsible for ensuring that your content and conduct do not violate law, infringe rights, or breach any agreement you have with another person or platform.

Acceptable Use

You may not use Oho to engage in unlawful, deceptive, abusive, infringing, harassing, or harmful conduct, or to interfere with the operation, security, or integrity of the service.

  • Do not upload malware, attempt unauthorized access, scrape the service in violation of our rules, or circumvent technical restrictions.
  • Do not use Oho to sell, promote, or distribute content or services that are unlawful, fraudulent, or that violate third-party rights.
  • Do not misuse buyer, brand, subscriber, or visitor information collected through Oho.

Payments, Billing, and Payouts

Paid platform plans, premium usernames, creator transactions, and other monetized workflows may be processed through third-party providers such as Stripe or Whop. Your use of those workflows may also be subject to the payment provider's terms and policies.

Paid plans may renew automatically until canceled through the applicable billing flow. You are responsible for taxes, governmental charges, chargebacks, and any obligations arising from your use of paid features or your sale of creator offers.

Platform fees, payout eligibility, payout review, refund handling, reserves, or access restrictions may vary by product, creator plan, provider, transaction status, or fraud and risk review.

Bookings, Digital Products, Newsletters, Collaborations, and Paid DMs

Oho includes distinct product workflows with their own operational rules. Booking availability, meeting links, approvals, delivery timing, collaboration revisions, escrow-style review states, newsletter access, and paid DM response windows depend on the settings configured for the relevant creator workflow.

Certain features may include workflow-specific refund or expiry logic. For example, paid DM conversations and paid bookings can involve provider-managed refunds, and digital product access can be delivered through expiring links or external URLs.

Creators are responsible for accurately describing what they are offering, the delivery timeline, any revision rules, refund expectations, and any limitations or legal disclosures that apply to their own offers.

Third-Party Services and Links

Oho may integrate with or link to third-party services, including payment providers, analytics tools, email providers, calendar providers, social networks, storage providers, and websites operated by creators or other users. We do not control those third-party services and are not responsible for their availability, content, or practices.

Termination and Suspension

You may stop using Oho at any time. We may suspend, limit, or terminate access to the service, remove content, invalidate links, delay payouts, or cancel transactions where we reasonably believe it is necessary to protect users, enforce these terms, investigate abuse, comply with law, or address platform risk.

Sections of these terms that by their nature should survive termination will survive, including provisions about payments due, intellectual property, disclaimers, liability limits, indemnity, and dispute-related records.

Disclaimers

Oho is provided on an as-is and as-available basis. To the maximum extent permitted by law, we disclaim all warranties, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, title, non-infringement, and uninterrupted or error-free operation.

We do not guarantee any particular business result, revenue outcome, conversion rate, deliverability rate, payment success rate, or availability of any third-party integration or provider.

Limitation of Liability

To the maximum extent permitted by law, Oho and its affiliates, officers, employees, and licensors will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, data, goodwill, business opportunity, or substitute service costs arising out of or related to the service.

If liability cannot be excluded, Oho's aggregate liability for claims arising out of or relating to the service will not exceed the greater of the amount you paid Oho for the applicable service during the twelve months before the event giving rise to the claim or one hundred U.S. dollars (US$100).

Indemnity

You will defend, indemnify, and hold harmless Oho and its affiliates, officers, employees, and agents from and against claims, damages, losses, liabilities, costs, and expenses, including reasonable legal fees, arising out of or related to your content, your offers, your use of the service, your misuse of personal information, or your violation of these terms or applicable law.

Changes to These Terms

We may update these Terms of Service from time to time. When material changes are made, we may provide notice through the service, on the website, or by another reasonable method. Your continued use of Oho after the updated terms take effect means you accept the revised terms.
